Terms of Use

The terms that apply when you use Nearvy.

Acceptance of Terms

By creating an account or using the Nearvy app, you agree to these Terms of Use. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old to use Nearvy. By using the app, you confirm that you meet this age requirement.

User Accounts

  • You are responsible for maintaining the security of your account.
  • You must provide accurate information during registration.
  • You may not create accounts for others or use someone else’s account.
  • You may delete your account at any time in Settings → Delete Account.

User-Generated Content

Nearvy allows users to create events, send messages, and share profile information. By submitting content, you grant Nearvy a non-exclusive license to display that content within the app.

Zero Tolerance Policy

We have a zero tolerance policy for objectionable content and abusive behavior. The following content is strictly prohibited:

  • Sexually explicit or pornographic material
  • Content that promotes violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic
  • Harassment, bullying, or threats directed at other users
  • Spam, scams, or misleading information
  • Content that violates any applicable law
  • Personal information of others shared without their consent
  • Content involving minors in any inappropriate context

Content Moderation

  • Users can report inappropriate content or abusive users using the “Report” button on profiles and events.
  • Users can block other users to prevent unwanted contact.
  • We review all reports within 24 hours.
  • We reserve the right to remove any content and suspend or terminate accounts that violate these Terms without prior notice.

Child Safety Standards

Nearvy has a zero tolerance policy for child sexual abuse and exploitation (CSAE). We strictly prohibit:

  • Any content that sexually exploits or endangers children, including child sexual abuse material (CSAM)
  • Grooming behavior — any attempt to build a relationship with a minor for the purpose of sexual exploitation
  • Sextortion of minors — threatening to share intimate images of a minor
  • Trafficking of minors — any activity that facilitates the exploitation of children
  • Any other content or behavior that endangers minors

We will immediately remove such content, terminate the offending account, and report it to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities. Users can report suspected CSAE content via the in-app Report function or by emailing oleg.yanki@gmail.com.

Prohibited Conduct

You agree not to:

  • Use the app for any illegal purpose
  • Impersonate other users or create fake profiles
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use automated tools to scrape or collect data from the app
  • Interfere with the app’s normal operation

Location Data

By using location-based features, you consent to the collection and use of your location data as described in our Privacy Policy. Your location is only visible to other users when you explicitly start a Live Walk.

Intellectual Property

The Nearvy app, including its design, code, and content created by us, is owned by Nearvy and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

Disclaimers

  • Nearvy is provided “as is” without warranties of any kind.
  • We are not responsible for the content created by users.
  • We are not responsible for any meetings or interactions that occur between users in real life. Use common sense and stay safe.

Limitation of Liability

To the maximum extent permitted by law, Nearvy shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of Ukraine.
